Terms of Service

1. Acceptance of Terms

By accessing or using RMB Qwizio, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the platform. Use of the platform constitutes acceptance of the most current version of these Terms.

2. Description of Service

RMB Qwizio is a web-based assessment and training evaluation platform provided by RMB Enterprise, LLC. The platform allows organizations to create, administer, and analyze assessments for workforce training purposes. RMB Qwizio is not a certified training provider and does not issue IWCF, IADC, or any other industry certification. Assessment results are for internal evaluation purposes only.

3. Subscriptions and Billing

• Subscriptions are billed monthly in advance on a recurring basis.
• Available plans: Starter ($49/mo), Professional ($149/mo), Enterprise ($349/mo).
• Subscriptions automatically renew each month until canceled.
• You may cancel at any time through your account settings or by contacting support; cancellation takes effect at the end of the current billing period.
• All fees are charged in USD via credit card through our secure payment processor (Stripe).
• Invoice/purchase order billing is available for Enterprise accounts upon request.
• RMB reserves the right to change pricing with 30 days written notice to the email on file.

4. No Refunds

All subscription fees are non-refundable. No refunds or credits will be issued for partial months, unused features, or early cancellation. If RMB terminates your account without cause, you will receive a prorated refund for the unused portion of your current billing period.

5. Free Trial

RMB may offer a free trial at its sole discretion. Free trial eligibility, duration, and terms will be communicated at the time of offer. RMB reserves the right to modify or discontinue any free trial offer at any time.

6. Data and Privacy

• You retain ownership of all data you upload or generate on the platform, including quiz content, student records, and assessment results.
• Upon cancellation or termination, you have 30 days to export your data. After 30 days, RMB may permanently delete your data with no liability.
• RMB may use anonymized, aggregated data derived from platform usage to improve services.
• RMB will not sell your data to third parties.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose.
• Attempt to reverse engineer or copy the platform.
• Resell or sublicense access to third parties without written consent.
• Upload content that is defamatory, obscene, or infringes third-party rights.
• Interfere with platform security or other users' access.

8. Intellectual Property

RMB Qwizio, including its software, design, and content, is the property of RMB Enterprise, LLC and is protected by intellectual property laws. You retain ownership of content you create. You grant RMB a limited license to host, display, and process your content solely to provide the service.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. RMB DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS. USE OF THE PLATFORM IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RMB’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO RMB IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. RMB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the courts of Harris County, Texas.

12. Changes to Terms

RMB reserves the right to modify these Terms at any time. We will notify you by email or platform notification at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
